These Terms & Conditions apply to your use of merkeusa.com, which is operated by Merkentile Apparel LLC under the MERKE brand. By using the site or proceeding to checkout, you agree to these Terms to the extent permitted by applicable law.
Acceptance and scope.
These Terms govern the MERKE website, including product presentation, First Access, the bag experience, and links to checkout. Separate terms, policies, and confirmations presented during Shopify checkout also apply to the purchase and prevail where they specifically address that transaction.
If you do not agree to these Terms, please do not use the site or proceed to checkout.
Site, products, and availability.
MERKE may change, pause, or discontinue site features, product availability, content, and access without notice where permitted by law. We work to present product information accurately, but screen displays, lighting, production variation, and device settings can affect how colors and details appear.
Product availability, selected variants, pricing, and applicable taxes are confirmed at checkout. A product’s presence on the site does not guarantee that it is available for purchase in every location or at every time.
Orders and secure checkout.
The MERKE bag hands off to Shopify for checkout. Shopify controls checkout, payment processing, taxes, shipping options, and order processing. By submitting an order, you agree to provide complete and accurate information and authorize the payment method presented at checkout.
An order confirmation acknowledges that we received an order request; it does not by itself guarantee acceptance, inventory availability, or shipment. We may cancel or limit an order when necessary to address availability, apparent errors, suspected misuse, fraud, or legal requirements, subject to applicable law.
Edition statements.
MERKE may describe an edition as limited, individually numbered, fixed allocation, made once, not restocked, or archived after close. Those statements describe the stated edition and are not a promise of resale value, future availability, or collector value. Future editions may have distinct designs and their own stated allocation terms.
Where an edition number is assigned, it identifies the individual piece within the applicable edition allocation. It does not create an investment product, a transferable warranty, or a guarantee of rarity beyond the applicable stated edition terms.
Acceptable use.
You may use this site for lawful, personal shopping and information purposes. You may not interfere with the site, bypass security or access controls, use automated means to disrupt access, submit false information, or use MERKE content in a way that infringes rights or misrepresents your relationship with MERKE.
MERKE intellectual property.
The MERKE name, artwork, product presentation, photography, copy, edition-system content, and site design are protected by applicable intellectual-property laws. They may not be copied, reproduced, modified, or used commercially without prior written permission from Merkentile Apparel LLC.
Disclaimers and limits.
To the fullest extent permitted by applicable law, the site is provided on an “as available” basis and MERKE does not make warranties beyond those that cannot lawfully be excluded. Nothing in these Terms limits rights or remedies that applicable consumer law does not allow us to limit.
To the fullest extent permitted by law, Merkentile Apparel LLC is not liable for indirect, incidental, special, consequential, or punitive losses arising from use of the site. Where liability cannot be excluded, it is limited to the minimum extent allowed by applicable law.
Changes to these Terms.
We may update these Terms as the website, checkout experience, or legal requirements change. The date above identifies the most recent revision. Continuing to use the site after updated Terms take effect means you accept the revised Terms to the extent permitted by law.
